Charterbedingungen < Präambel: 1. Pecumedia GmbH, Abt. Yachtchartervermittlung Charterpartner Trautenwolfstr.5 D-80802 München, nachfolgend Charterpartner genannt, tritt als Agentur im Namen und Auftrag für den genannten Vercharterer auf . 2. Es werden ausschließlich Geschäfte im fremden Namen und auf fremde Rechnung getätigt. Ansprüche aus den Verträgen sind zwischen den Vertragspartnern direkt zu regeln. 3. Es gelten nur schriftliche Vereinbarungen, mündliche Vereinbarungen bedürfen zu ihrer Gültigkeit der Schriftform. Sollte eine Bestimmung dieses Vertrages ungültig sein oder werden, so ist die ungültige Regelung durch eine solche gültige zu ersetzen, die dem gewollten Sinn und Zweck der ungültigen Bestimmung in zulässiger Weise entspricht. Der Vertrag an sich bleibt davon unberührt. 4. Es gilt spanisches Recht und die Bedingungen in spanischer Sprache sind bindend. 5. Der Vercharterer kann beim boarding eine physische Ausfertigung dieses Chartervertrages mit diesen Konditionen zur Unterschrift vorlegen. Der Chartervertrag gilt bis dahin als geschlossen durch Online-Zustimmung und Zahlung der genannten Charterraten. Für die Charter der in der Rechnung genannten Yacht gelten folgende Charterbedingungen des Vercharterers : Der Chartervertrag wird zwischen der Charterfirma (Vercharterer: < CONDICIONES GENERALES/GENERAL CONDITIONS < 1-Condiciones de pago: La vigencia del presente contrato queda supeditada al pago del importe de la reserva. 2-Anulación:
2-Cancellation: - In case of cancellation 60 days prior to embark, client will be refunded with 50% of the total amount paid. - In case of cancellation 45 days prior to embark, client will not be refunded. 3-Fianza: El día del embarque el arrendatario entregará a la arrendadora la fianza que se indica en las condiciones particulares, con la que responderá de las averías, roturas, desperfectos, robos, retrasos en la devolución de la embarcación, diferencias en el inventario y equipamiento, indemnizaciones, mal uso, negligencia y penalizaciones de cualquier índole pactadas en el presente contrato o que pudieran surgir como consecuencia del incumplimiento del mismo. Todo ello sin perjuicio de las acciones legales que fueran procedentes para reclamar aquellos importes que superasen el de la fianza. 3-Deposit: The day of shipment the lessee shall deliver to the lessor the deposit as indicated in the general conditions that respond to faults, cracks, damage, theft, delays in returning the boat, differences in inventory and equipment, compensation , misuse, neglect, and penalties of any kind agreed in this contract or that may arise from the breach of it. This is without prejudice to legal actions that were coming to claim the amounts that exceeded that of the bond. 4-Seguro: La embarcación objeto del presente contrato se halla cubierta con una póliza de seguro a todo riesgo con franquicia, de la que se adjuntará una copia un mes antes del embarque. El lucro cesante no está cubierto por el seguro. Por tanto, en caso de que la embarcación sufra daños durante el alquiler que impidan su posterior arrendamiento, el cliente pagará un máximo de 4.000 € (la fianza de 2.000 € + 2.000 €) para cubrir dichos daños. 4-Insurance: The vessel covered by this contract is covered with an insurance policy with excess, which is attached a copy one month prior to shipment. Loss of earnings is not covered by insurance. Therefore, if the boat is damaged during the rental period to prevent further lease, the customer will pay a maximum of 4,000 € (deposit of 2,000 € + 2,000 €) to cover such damages. 5-Inventario: A la entrega de la embarcación, ambas partes procederán al check-in y correspondiente inventario. Una vez realizado, se suscribirá el correspondiente documento acreditativo y de conformidad. 5-Stock: Upon delivery of the vessel, both parties will proceed to check-in and related inventory. Once completed, contract will be signed and the corresponding supporting document of compliance and agreement. 6-Devolución de la embarcación: La embarcación deberá devolverse en el tiempo y lugar que se determina en las condiciones particulares del presente contrato. La embarcación deberá ser devuelta en idénticas condiciones de funcionamiento, equipamiento e inventario, a las del alquiler. Todos los perjuicios que los deterioros o pérdidas produjeran, en el supuesto de que no quedarán cubiertos por la póliza de seguro de la embarcación, serán de cuenta del arrendatario. 6-Return of the boat: The boat must be returned in time and place to be determined by the particular conditions of this contract. The boat must be returned under identical operating conditions, equipment and inventory, same as the beginning of the lease. All damages that the damage or loss occur, assuming that is not covered by the insurance policy of the vessel, shall be paid by the lessee. 7-Averías de la embarcación previas al alquiler En el supuesto de que la embarcación para la cual se había realizado la reserva tuviese una avería previa que imposibilite su arrendamiento para las fechas reservadas, la arrendadora además de ponerlo en conocimiento del cliente tan pronto como tenga conocimiento de la misma, procederá a sustituir la citada embarcación por otra similar siempre y cuando contase con embarcaciones disponible para ello, de lo contrario, reembolsará al cliente la totalidad de la cantidad pagada, quedando el arrendador exonerado de cualquier indemnización posterior. 7-Damage to the vessel prior to the rental: In the event that the boat used to make the reservation would have a breakdown that precludes its lease prior to the reserved dates, the lessor in addition to putting the knowledge of the customer as soon as it has knowledge thereof, the cited shall be replaced by other similar boat as long as it should count with other boats available for it, otherwise, the company will reimburse the customer the full amount paid, renter being relieved of any further compensation. 8-Averías de la embarcación durante el contrato: Las averías ocasionadas como consecuencia del mal uso de la embarcación tales como deterioro de mobiliario y menaje, obstrucciones en saneamientos y desagües, entre otras, que conlleve reparación inmediata y en consecuencia la imposibilidad de que la embarcación esté a disposición de ser nuevamente alquilada, dará lugar además de la perdida integra de la fianza depositada a la reclamación al cliente de los gastos generados como consecuencia de dicho deterioro por el perjuicio ocasionado. El arrendatario no ordenará ninguna reparación sin antes haber comunicado la avería a la arrendadora quien deberá autorizar previamente su permiso. Las averías consecuencia de la negligencia (arañazos y golpes) o deficiente uso de la embarcación por el arrendatario, serán abonadas por éste en su integridad, y la arrendadora dará por resuelto el presente contrato y se reservará el ejercicio de la reclamación de los daños y perjuicios que la avería pudiera irrogar. 8-Damage to the vessel during the contract: Faults caused as a result of misuse of the vessel such as deterioration of furniture and utensils, sanitation and drainage obstructions, inter alia, that involves immediate repair and therefore the inability of the boat to be rented again, will cost the loss of the intergrate amount of the deposit on behalf of the customer, claim expenses incurred as a result of such impairment by the injury. Failures due to negligence (scratches and bruises) or poor use of the vessel by the lessee, shall be paid by customer in its entirety, and the lessor will terminate the present contract and reserves the exercise of the claim for damages and the damage occured. 9-Retenciones administrativas (captura y confiscación): La negligencia o uso indebido del barco, infringiendo la legislación vigente por parte del arrendatario, será motivo suficiente para la rescisión instantánea del contrato. En caso de infracción por el arrendatario de las ordenanzas de aduanas o de cualquier otra Administración, éste responderá de todas las multas, sanciones o responsabilidades a que hubiera lugar, así como a todas sus consecuencias. En caso de captura y confiscación de la embarcación, el arrendatario abonará a la arrendadora en concepto de indemnización por los daños y perjuicios ocasionados el 15 % del importe de la embarcación en el plazo de treinta días hábiles contados desde el mismo momento que se produzca dicho hecho. En todos los casos el arrendatario perderá, en beneficio de la arrendadora, las cantidades entregadas. 9-Withholding administrative (capture and confiscation): Negligence or misuse of the boat, breaking the existing law by the lessee, will be sufficient motive for instant termination of the contract. In case of capture and confiscation of the vessel, the lessee shall pay to the lessor by way of compensation for damages caused by 15% of the vessel amount within thirty working days from the moment that this fact occurs. In all cases, the leesee will lose the quantities delivered for the benefit of the lessor. 10-Gastos: Todos los gastos de avituallamiento, carburante, lubricantes, hielo, amarres en puertos y marinas, serán de exclusivo cargo del arrendatario. 10-Expenses: All expenditures for supplies, fuel, lubricants, ice, mooring in harbors and marinas, are the exclusive responsibility of the lessee. 11-Titulación: El arrendatario deberá presentar conjuntamente con el D.N.I., el original del título náutico en el momento del embarque. 11-License: The lessee shall submit together with the ID card or passport, the original title of sailing (navigation license) at the time of the embark. 12-Condiciones de uso: El arrendatario responderá de todos los actos de las personas indicadas en la lista de pasajeros, que no podrán sobrepasar en ningún caso la capacidad máxima de la embarcación. Queda terminantemente prohibido utilizar la embarcación para el transporte de mercancías, de viajeros distintos a los señalados en el punto anterior, el embarque de armas, animales, estupefacientes o cualquier sustancia tóxica o peligrosa. El arrendatario se obliga a usar la embarcación exclusivamente como chárter turístico o de recreo por lo que en ningún caso puede destinarla a operaciones de comercio, pesca profesional, competiciones deportivas, y cualesquiera otras incompatibles con el destino del barco. El arrendatario como único responsable de la embarcación durante el arrendamiento hará uso de ella con responsabilidad, acatando las normas de las autoridades con competencia al efecto, siendo responsables único y exclusivo de las consecuencias que se derivarán del incumplimiento de las mismas. 12-User conditions: Lessee is responsible for all acts of the people named in the passenger list, which may not exceed in any case the maximum capacity of the boat. It is forbidden to use the vessel for the transportation of goods or travelers, other than those listed in the previous point, the shipment of weapons, animals, drugs or any toxic or hazardous substance. The lessee is obliged to use the boat exclusively as a charter boat or recreational tourism so that in no case it will be destined for trading transactions, commercial fishing, sports competitions, and any other inconsistent with the destination of the ship. The lessee has sole responsibility of the vessel during the lease and will use it responsibly, obeying the rules of the competitive authorities for the purpose, being solely and exclusively responsible for the consequences that will result from the breach of them. 13-Accidentes: El arrendatario se compromete a informar inmediatamente de cualquier siniestro a la arrendadora y a transmitirle inmediatamente cuantas cartas, citaciones o notificaciones que a dicho siniestro se refieran y a prestar completa colaboración a la arrendadora y a la Compañía Aseguradora en la investigación y defensa de cualquier reclamación y proceso. En caso de robo de la embarcación, el arrendatario está obligado a presentar la correspondiente denuncia del hecho ante la autoridad competente, entregando la misma a la arrendadora. 13-Accidents: The Lessee agrees to immediately report any loss to the lessor and immediately transmit any letters, summonses or notices relating to this incident and to provide full cooperation to the lessor and the Insurer in the investigation and defense of any claim and trial. In case of theft of the boat, the lessee is required to submit the corresponding report on the matter before the competent authority and hand it to the lessor. 14-Fuero: Para la solución de cualquier controversia como consecuencia del presente contrato las partes se someten a la Autoridades Administrativas y Tribunales de la ciudad de Madrid, renunciando para ello a su propio Fuero. 14-Jurisdiction: For the resolution of any disputes arising from this contract, the parties submit to the Administrative Authorities and Courts of Madrid, renouncing their own jurisdiction thereof. El inventario se firmará en el momento del embarque. Es orientativo, puede sufrir alguna modificación. / The inventory will be signed at the time of the embark. It may not be exact and might suffer some modifications. |
